What is Aurea? |
1. Welcome to Aurea, we are thrilled to have you with us! Through our web interface (the "Platform"), the company specifically provides users (hereinafter referred to as "End Users") with a web interface that acts as an aggregator of multiple regulated service providers in the fields of digital banking, crypto, DeFi wallet, and Web 3.0 (collectively, the "Service"). 2. The Service is provided by Aurea Hub S.r.l., with registered office at Via Giosuè Carducci 18, 20123, Milan (MI), Italy, VAT number 12889220963 ("Aurea"). |
What is this document? |
1. This document sets out the terms and conditions (the "Terms") that govern the relationship between you, as an End User, and Aurea, for the use of our Platform and the Service offered. By using the Platform, you fully accept these Terms. 2. We reserve the right to modify them at any time: after each update, we will send you a notification to the email address you provided and publish the changes on our website https://www.aureahub.com/ (the "Site"). We recommend you check the Site periodically to stay up to date. 3. The new Terms will become effective 15 days after publication. If you do not accept the changes, you may withdraw from the Service as provided in Article 8. |
How can I use the Service and create my account? |
1. To use the Service offered by Aurea, the End User must first create an account through the application (hereinafter, the "App"). 2. Once registration is completed, the End User can use the App's interface to browse and access the services available from Aurea's Partners. 3. We ask that you be transparent with us and provide accurate and up-to-date information. It is strictly forbidden to use false data or impersonate another person during registration. 4. Access to Partner services takes place in an integrated manner, but without Aurea directly managing transactions or holding funds. When the End User selects a service, they are automatically redirected to the Partner's interface, where they can complete the procedure and finalize the operations in accordance with the Partner's own terms and conditions. 5. Registration to the App is free and involves no additional costs. 6. You are solely responsible for the security and confidentiality of the information contained in your account. 7. In case of loss, theft, or suspected unauthorized access by third parties, please promptly inform Aurea and immediately change your login credentials. 8. Under no circumstances can Aurea be held liable for loss, disclosure, theft, or unauthorized use, for any reason, of your Aurea account login credentials by third parties. |
I'm an End User. How does the Service work? |
1. Through the App, you can access an advanced interface that allows you to easily and immediately use the services offered by our Partners. 2. To use the Service, follow these simple steps: - Create your account: complete the registration by entering your email address or log in via Google or Apple ID. You may also optionally choose a username. - Access the Home page: within the App, you'll find an intuitive interface that allows you to explore and select the services offered by Aurea's Partners. - Bank account creation: If you choose to activate banking services - offered by Wirex - available in the App, you will be asked to enter some personal information: first name, last name, email address, and residential address. Then, you will be redirected to complete the identity verification process (KYC), carried out directly by the service provider. Once the verification is successfully completed, you will have access to all banking services provided by Wirex LTD and its affiliates. If your identity is verified at this stage, the collected data will be automatically shared with the partner Transak LTD, via the provider Sumsub, to enable the purchase and sale of cryptocurrencies offered by Transak, without needing further verifications from you. The authentication completed for the Wirex bank account is also valid for accessing Transak services. On the other hand, authentication carried out only for Transak does not automatically activate the bank account, so as not to oblige users to open one if they do not wish to. - Start a transaction: if you wish to buy or sell cryptocurrencies, access the interface of the selected Partner. On the first use, you will need to complete the identity verification (KYC) process required directly by the service provider. Once verified, you can carry out transactions quickly and without further steps. - Manage your transactions: through the App, you can monitor the status of transactions made with the Partners, always having visibility on ongoing processes. The App acts as a web interface that channels End Users toward the services offered by the Partners, without directly intervening in financial transactions or fund custody. You, as a client of the various Partners, will independently select which Partner services you wish to use from time to time. In the future, an integration between Partners' KYC processes will be introduced to make the experience even smoother, allowing you to enter your data once and use them for multiple services. 3. The End User, at their sole discretion and on a voluntary basis, may choose to subscribe to an income tax declaration assistance service made available through a collaboration between the Platform and Tatax S.r.l. (hereinafter "Tatax"). By subscribing to the service, the End User agrees to the sharing, between the Platform and Tatax, of the following data, strictly limited to what is necessary for tax assistance purposes: (i) data available in the Transak End User dashboard; (ii) data collected during the registration phase to the platform (sign-up); (iii) data relating to transactions carried out through Wirex (once implemented). Data sharing will occur exclusively for End Users who have explicitly consented to the service offered by Tatax, and will be governed by a dedicated privacy policy (https://drive.google.com/file/d/1Ubja3eqFxNqefY5h_WKNKK9QPvMDaIdN/view) provided upon subscription. It is understood that the use of the Tatax service is optional and in no way affects the End User's ability to access or continue to use other services offered by the platform. |
Can I delete my account? |
1. You can delete your account and all information contained in it at any time by accessing the Home page and checking the appropriate settings section. 2. Alternatively, you can delete your account and all associated information by sending a specific request to the email address help.aureahub@gmail.com. 3. The deletion of your account will be completed within 30 (thirty) days from the receipt of the request. Once the account is deleted, all your personal data will be erased in accordance with our privacy policy. |
What are my obligations? |
1. By signing up on the Aurea Platform, you agree to: - provide only truthful, correct, and complete information regarding your identity, academic and professional experience, and any other data required to use the Service; - protect and keep confidential your App login credentials, avoiding sharing them with third parties; - use the Platform in accordance with these Terms, respecting its purpose and refraining from unlawful, fraudulent, or harmful behavior towards Aurea or third parties. In case of breach of one or more obligations under these Terms, this contract shall be considered automatically terminated pursuant to Article 1456 of the Italian Civil Code, without prejudice to Aurea's right to claim compensation for any damage suffered, as well as to report to the competent authorities. |
Are there any liability limitations in favour of Aurea? |
1. Aurea Hub strives to provide a smooth and intuitive experience to facilitate access to services offered by its Partners. However, we cannot guarantee that the App will always be free of errors, interruptions, or malfunctions. Technical issues, system updates, maintenance, or force majeure events may temporarily affect the availability of the Service. 2. The Aurea Hub App serves solely as an interface allowing End Users to access third-party services, without directly handling transactions, order management, or fund custody. Therefore, Aurea is not responsible for issues arising from Partner services, including but not limited to: - Access interruptions or limitations due to technical malfunctions, maintenance, cyberattacks, or other events beyond our control. - Errors or inaccuracies in content: information about Partner services is provided directly by providers and may not always be up to date or accurate. You are encouraged to independently review Partner terms and conditions before performing any operation. - Regulatory compliance and KYC/AML checks: identity verification processes and compliance measures are entirely managed by Partners and third parties such as SumSub. Aurea does not carry out direct checks nor is it responsible for any delays or issues related to these processes. - Financial transactions: Aurea neither manages nor holds fiat or crypto funds, nor does it handle related transactions. - Outcomes of operations: the App provides simplified access to Partner services but does not guarantee the success of transactions, which depend solely on the involved financial service providers. - Modifications or suspension of services: Partners may modify, suspend, or discontinue their services without notice. Aurea is not responsible for any inconvenience arising from such changes. 3. Aurea cannot be held responsible for service disruptions, interruptions, delays, functional errors, or malfunctions of the App caused by external factors not directly manageable, including but not limited to internet connectivity issues, software bugs, improperly installed updates, device or OS incompatibility, server failures, or third-party errors. 4. Aurea shall not be liable for financial losses, indirect damages, lost profits, or harmful consequences resulting from such malfunctions, unless directly attributable to Aurea's wilful misconduct or gross negligence. 5. Aurea does not act as intermediary or representative of Partners and does not offer financial or legal advice, nor does it serve as a financial educator. The End User is responsible for using the Service in compliance with applicable laws and independently assessing the reliability and suitability of services offered by Partners. 6. Aurea acknowledges that services accessible through the Platform are subject to regulations and authorization processes. However, each Partner is responsible for possessing all licenses, authorizations, and meeting regulatory requirements in the countries where they operate. 7. The End User acknowledges that Aurea is in no way responsible for Partners' compliance with legal obligations. 8. By accepting these Terms, the End User agrees to indemnify and hold Aurea harmless from any claims, damages, or costs resulting from the use of the App or third-party services accessed through it. |
When can you withdraw from this contract? |
1. You may unilaterally withdraw from this contract as specified in Article 5 of these Terms. 2. Aurea reserves the right to withdraw from this contract at any time by notifying you via email or other written communication, with 15 days' notice. 3. It is understood that in the event of withdrawal, your data and the information associated with your account will be processed and retained in accordance with applicable data protection laws and our privacy policy. |
Privacy |
1. The personal data you provide will be processed by Aurea Hub with the utmost care and in full compliance with current data protection regulations, including Regulation (EU) 2016/679 ("GDPR") and Legislative Decree 196/2003 ("Privacy Code"). For more details on the processing of your data, please refer to our Privacy Policy at the following link: https://www.aureahub.com/privacy-policy. 2. Your personal data will be used exclusively to provide you the Service and ensure an optimized experience within the App. In particular, Aurea Hub will use your data to: - Create and manage your account and allow you to access the services available on our platform. - Facilitate access to Partner services, by redirecting you to third-party platforms to complete operations such as fiat-to-crypto or crypto-to-fiat conversion. - Notify you of updates and notifications related to the App's features, in accordance with your contact preferences. 3. Aurea Hub does not collect or process data relating to your financial transactions or operations carried out with Partners. Identity verification (KYC) and regulatory compliance checks are managed directly by service providers (e.g., Transak and Wirex) through the provider SumSub, without Aurea having access to such information. 4. If the App is updated with personalization or data analysis features, the processing will always be based on your consent, which you can provide or revoke at any time by writing to: help.aureahub@gmail.com. 5. If you provide us with personal data of third parties (e.g., contacts or referees for registration), you guarantee that you have lawfully obtained such data with the consent of the individuals concerned, where required. Aurea Hub cannot be held liable for the processing of third-party data provided without authorization. By accepting these Terms, you agree to indemnify and hold us harmless from any damage, claim, or sanction resulting from breaches of data protection laws. |
Intellectual Property |
1. The Aurea Hub Platform and all related content, including but not limited to texts, graphics, logos, icons, images, software, databases, registered or unregistered designs, trademarks, patents, copyrights, and any other intellectual or industrial property rights (hereinafter, "IP Rights"), are the exclusive property of Aurea or its licensors and are protected by applicable national and international laws. 2. Aurea grants you a personal, limited, non-exclusive, non-transferable, and revocable license to access and use the Platform solely for the purpose of using the Service and for the duration of this contract. You are not allowed to: - Claim any ownership, title, or economic exploitation rights over the IP Rights; - Modify, copy, distribute, reproduce, transmit, publish, create derivative works, sublicense, sell, or otherwise exploit the IP Rights without Aurea Hub's prior written consent. 3. You agree to refrain, during and after the term of the contract, from committing any act that could harm or infringe in any way Aurea's IP Rights. 4. In case of IP Rights violation, Aurea reserves the right to take all necessary legal measures to protect its rights, including compensation for any damages incurred. |
Term |
1. These Terms shall take effect for registered End Users of the Platform from the date of acceptance during the Registration process. 2. Your right to withdraw, as indicated in Article 8 of these Terms, remains unaffected. |
Governing Law and Jurisdiction |
1. These Terms are governed by Italian law. 2. Any disputes regarding the validity, interpretation, execution, termination, or cancellation of this agreement shall fall under the exclusive jurisdiction of the Court of Milan, without prejudice to the application of the competent court based on your residence or domicile if you are identified as a Consumer under current legislation. |
